Article 1 : Denomination & designation

Wild Lingerie is a proprietorship having its own website www.wild-lingerie.com

The proprietorship Wild Lingerie, will be designated in these terms and conditions by the term “Wild Lingerie”.
The person, in capacity of consumer, related to Wild Lingerie by an act of purchasing on the website www.wild-lingerie.com, will be designed in these terms and conditions by the term “Client”.

Article 2 : Application of terms and conditions

These terms and conditions apply at the moment of the conclusion of order contract, and are sent to the Client by way of an email confirming the order.

The Client declares to have acknowledged and accepted these terms and conditions before placing an order. Any order made by the Client constitutes the complete acceptation of the present terms and conditions. The Client must be over 18 years of age to be able to place an order. The Clients under the age of 18 must have an authorization from their parents. The website www.wild-lingerie.com is written in French and English as well as all steps, electronic or not, necessary for the validation of the order by the customer. Therefore the sale contracts between Wild Lingerie and the customer are in French and English.

Article 3 : Products

Wild Lingerie undertakes to honour orders of the products available on the website www.wild-lingerie.com, only within the limit of available product stock. Despite the most precise description of the products in different categories, the photographs, the texts, the graphic design and the information illustrating the presented products are not contractual. Hence, Wild Lingerie is not responsible for eventual errors. If you note an error published on the website, please contact us using the "Contact us" form on the site.

Article 4 : Stock shortage

Wild Lingerie agrees to prevent by an e-mail the Client placed an order for unavailable product.In case of purchasing an unavailable product by the Client, Wild Lingerie agrees to offer to the Client reimbursement or a purchase voucher within 30 days maximum. If the ordered product is temporary unavailable, Wild Lingerie can suggest to the Client, if he wishes so, to wait until the unavailable product is restocked.

Article 5 : Validity of the offer

The offers on the website wild-lingerie.com, are only destined for customers who have a delivery address in metropolitan France, in France's overseas departments and territories, in any country of the European Union or in any country outside the European Union cited in the Article 9 of these general conditions of sale.

Article 6 : Price

The prices listed on the website www.wild-lingerie.com are net in euros without the application of VAT and excluding shipping costs. Wild Lingerie reserves the right to change the prices at any time and without prior notice. The products remain the property of Wild Lingerie until the integral payment of the price of the order. The integral payment of the price of the order must be made during the ordering process. The sums paid can never be considered to be deposits or part payments.

Article 7 : Ordering

Once the Client has filled his basket, he has to log in using his Client IDs and password if he has already an account on www.wild-lingerie.com, or he must complete the registration, which will be requested at the time of validate his basket. In this form the Client must enter his last name, first name, address, e-mail and telephone number. Then the Client will be able to confirm the order including the following information: the nature of selected products, the quantity, the unit price, the total amount of the order, and the shipping address of the Client. The Client can change or cancel the order at any moment before the payment. The validation of order requires the acceptance of these general conditions of sale, by ticking the appropriate box at the moment of the order validation by the Client.

Article 8 : The payment

The website www.wild-lingerie.com, offers two payment methods to the French Client. The Client who does not have a shipping address in France, will be offered 1 payment method (Paypal). Wild Lingerie may refuse to take into account and deliver an order from a customer involved into a dispute regarding a payment of a previous order.
After the validation of the order, the Client can choose to pay the order by:

Bank card and Paypal account (Paypal)

Card payment without PayPal account:

The Client may settle his order with Maestro Card, 4 étoiles Card, American Express, Aurore, Discover, Cofinoga, CB, Visa and Mastercard. The Client can visit the PayPal website to learn more information about any other accepted payment method. The Client is not obliged to have a PayPal account to pay the order.
Payment is due immediately and is made upon ordering. The transmission of the Client’s bank account informations is securely made on the PayPal website (SSL encryption). The Client’s bank account informations are to be reentered during each order made by the Client and will not be saved afterwards. The website www.wild-lingerie.com does not have access to these informations.
The operation is completely insured by the PayPal website.

Payment with PayPal account:

The Client must have a PayPal account to settle the order by using this payment method. If the Client settles his order with his PayPal account, the general conditions of use of PayPal are applied while paying on the PayPal platform.

Cheque

Only cheques in euros which holders have a domiciled bank account in France are accepted. The payment by several cheques is not accepted.  The Client has two days after the validation of his order to send a cheque equal to the whole amount of the order accompanied with the order number. As soon as Wild Lingerie receives the cheque, it will cashed and verified from banks. After verification, the order will be sent.

For the purposes of safety policy, Wild Lingerie can ask the Client to send his identity proof. These documents will not be saved by Wild Lingerie and will not be given to any other person. In the event that the Customer does not send these documents, Wild Lingerie reserves the right to cancel the order placed by the Client.

Wild Lingerie ships orders from Monday to Friday (excluding public holidays and exceptional closure days). Every order made on a business day before midday is shipped the same day. The other orders made after midday are shipped the next say (excluding Saturday and Sunday).

Delivery times are given below in accordance with the mode of transportation chosen by the Client with respect to his geographical zone. The delivery is accomplished when the Client collects his order at pick-up points or at a post office, or when the order is delivered directly by hand or to the letterbox of the Client.

It is possible that the Client’s order contains products with variable processing and shipping time. For logistical reasons, Wild Lingerie can ship separately these particular products.
The items, ordered by the Client, are shipped to the delivery address indicated in the payment form of the site www.wild-lingerie.com.
The Client must provide all information necessary for the delivery during the ordering process in order to allow the carriers to complete the delivery. Wild Lingerie will not be responsible for incorrect or incomplete delivery address information. In the latter case, the carrier will return the parcel to Wild Lingerie. The parcel will be resent to the Client implying additional costs.

A number of transportation services are available for the Client: Mondial Relay, La Poste Colissimo and Chronopost.

For France, the Chrono13 service ensures to deliver the parcel within 24 hours max.
Any order in stock placed before midday is delivered the next day after the shipping before 1 pm. For offshore islands the parcel is delivered two days after shipment.

**Europe 2: Liechtenstein, Switzerland, Vatican.

When receiving his order, the Customer may be liable for import tax and charges for customs clearance on goods entering on a country which is not in European Union. These tax/duties are not systematically demanded.
We are not able to know the amount of these tax/duties, which depends on the nature and on the value of the goods ordered.
These tax/duties, when collected, are payable by the recipient of the parcel, in any country outside the UE. Thus, it is not inherent to the website www.wild-lingerie.com.

Terms

In case of absence or unavailability of the Client upon delivery of the package, he has a period of 14 days to collect his order. If the Client doesn’t collect the parcel within this period, the parcel is directly returned to Wild Lingerie.
Wild Lingerie can’t be responsible for delivery delays due to strike actions by transportation services, weather conditions, or other imponderables events defined by the legislation of the goods and property transportation.
The Client must examine the physical condition of the delivered parcel. Wild Lingerie will not accept any customer complaint if there is no observation note formulated at the post office.

Article 10 : Withdrawal period

In accordance with the articles L 121-16 of the Consumer Code, the Client has 14 days to make a withdrawal from the moment of the parcel receiving.

To learn more about the conditions of the return and the repayment of the ordered products after withdrawal made by the Client, please see the “Returns and Withdrawals” section of the Article 11 of these terms and conditions.

Article 11 : Exchange and Return

According to the Article 10 of these terms and conditions, the Client has 14 days after the parcel receiving to make an exchange or a return.

Exchange

The Client has a period of 72 hours following the communication of its decision to make the postal return of the concerned product(s) by post.

In case of exchange, the return costs are to be paid by the Client, but Wild Lingerie offers you free shipping (only for Metropolitan France), if you purchase new products.

- If the Client wishes to change the product for the same product in a different size, there is no particular procedure to do on the website. The Client must contact us at postmaster@wild-lingerie.com in order to declare his intention. He must return the product accompanied with the note indicating the desired size as well as the name and the address necessary for Wild Lingerie to resend the new product.

- -If the Client wishes to exchange a product for a different product, the Client must do the return procedure on the website (see instructions below) and return the product that has to be exchanged.
Then he must place a new order including the new desired products. Mondial Relay shipping costs will be free for the Client.
Wild Lingerie will provide the Client with a discount voucher including the amount of the previous order as well as a promo code allowing him to benefit from free shipping for a new order.
The Client can learn more information about discount vouchers by acceding the following section: My account > My discount vouchers.

- Return by post procedure -

The exchanges must be only made by La Poste. Wild Lingerie will not accept the exchanges of the products returned by Mondial Relay or any another transporter.

The Client is responsible for the sending. The complaints against the transporter are exclusively incumbent upon the Client.

- Terms -

The exchange can’t be made if the products have been already used or washed, or if they are not in their original packaging that must remain perfectly intact. For hygienic reasons, tights, leggings, socks and stockings as well as sex toys can’t be exchanged if they have been already tried on or if their original packaging has been opened.

If the present exchange conditions are not respected and the Client wishes to get back the returned product, the sending is to be paid by the Client.

Subject to the conditions described above, Wild Lingerie will, on receipt, exchange the returned products.

If the product has a proven defect, or if there is a mistake on part of Wild Lingerie concerning the product reference, Wild Lingerie will also offer a discount voucher to the Client. The discount voucher includes the amount of the Client’s charges for the product return (only standard sending). The Client must present a La Poste invoice.

Returns and Withdrawals

In case of retraction (equal to return of the total order), the Client has 14 days after notification of his decision to return the product(s) by post. For any other type of return, the Client has 72 hours after notification of his decision to return product(s) by post.

Wild Lingerie will refund all the payments received from the Client, including the shipping costs (with the exception of the additional costs resulting from the fact that the Client has chosen a delivery option other than the standard delivery option (the least expensive) suggested by Wild Lingerie (see conditions below).

In case of mistake or dissatisfaction, a return procedure must be performed on the website www.wild-lingerie.com.

- Return Procedure on the website www.wild-lingerie.com -

The Client can return products via the following section My account > Order history by clicking on “Details”. So he will see the details of the order and he will be able to tick the products he wants to return as well as their quantity.
Then the Client has to specify the reason of the return in the appropriate field, as well as the desired form of refund (credit card charge back or discount voucher).
To confirm the return, the Client has to click on “Generate a return”.
He must wait until Wild Lingerie confirms the return.
At this moment he can download the return coupon via the following section: My account > My returns in order to print it and to add it to the return parcel.
Then the Client will receive a credit note in order to prove the refund via the following section: My account > My credit notes.
If the Client wishes to get the refund in the form of discount voucher, he will receive the discount voucher equivalent to the value of the return via the section My account > My discount vouchers.
It the Client prefers to get money back on his credit card or on his PayPal account, the refund will be done as soon as the return has been accepted. Wild Lingerie is not responsible for the time necessary for the bank and PayPal to refund.

- Return by Post Procedure -

The returns have to be made by La Poste. Wild Lingerie will not accept any return from any other transporter or relay.

The Client is responsible for shipping cost as well as for the sending. Complaints against the transporter are incumbent upon the Client.

- Refund Method -

Depending on the Client’s choice, a discount code will be available in the section My account > My discount vouchers or the Client will be given a refund depending on the payment method at the purchase moment, directly on the credit card or on his PayPal account within 14 days after the return verification and confirmation by Wild Lingerie.
Wild Lingerie is not responsible for the time necessary for the bank and PayPal to refund.
If the Client settled his order by a discount voucher, the Client can only be refunded by getting a new discount voucher in place of the old one.

Article 12:  Identification

The Client gives permission to Wild Lingerie to store a cookie on the Client’s hard drive in order to facilitate his identification in the section "My account".

In accordance with the French law n° 78-17 on Information Technology, Data Files and Civil Liberty of 6 January 1978, the Client has the right of access, rectification and opposition regarding the data concerning the Client. To exercise his rectification right, the Client can log in and modify the appropriate settings. To exercise his access and suppression rights, the Client can send an e-mail via the section "Contact us".
Wild Lingerie is subject to a declaration with the National Commission for Data Protection and Liberties (CNIL).

Article 13 : Responsibility

Wild Lingerie is not the manufacturer of the products available on the site www.wild-lingerie.com and has an obligation of means.
Wild Lingerie cannot be held liable for any damages or harm resulting from the use of the Internet such as losses of data, intrusion, virus, service interruption or any other external involuntary problems.

Article 14 : Intellectual Property

Wild Lingerie is the holder and/or has the authorization to use the whole of the rights on logos, trademarks, distinctive signs, products images, databases and software used in its professional activity.
Therefore any representation or reproduction in whole or in part of these elements by any possible means is prohibited and will constitute a counterfeiting sanctioned by the articles L.335-2 and subsequent articles of the Intellectual Property Code unless the prior authorization by Wild Lingerie has been obtained.
Any representation or reproduction in whole or in part of the catalogue of the site www.wild-lingerie.com is strictly prohibited.
Any unwanted link directing to the site www.wild-lingerie.com must be removed at the simple request of Wild Lingerie.

Articles 15 : Applicable Law

The present general conditions are subject to French law. Any dispute will be the subject of an amicable resolution attempt.

Articles 16 : Partial Non-validation and Modification of the Terms and conditions

If one or more stipulations of the present terms and conditions are found invalid or declared as such by application of a law or a regulation, or following a final decision from a competent court, this shall not affect the validity of the other stipulations.
Wild Lingerie reserves the right to modify the present terms and conditions. If the Client disagrees with the new version of the terms and conditions, he must notify Wild Lingerie and stop using its services.
